Landlords And Quiet Enjoyment Issues

Quiet enjoyment refers to a tenant living without a great deal of disturbances. When you rent a place to live, you have the tight to expect certain things from your landlord. For example, a landlord cannot enter your home any time of day or night for just any reason. This is in violation of the law.

When your home has been entered unlawfully by a landlord, you have legal steps that you may take. This will force someone to cease causing difficulties for you. However, you should have a basic understanding of some important tenant landlord issues, before taking any action.

Landlords have several reasons that allow them to enter your home. For example, if you are moving in less than two weeks, the unit can be shown to people who wish to rent it. However, you must receive proper notice, well ahead of time.

Landlords can enter rental properties if they are borrowing money on the property. This gives them a chance to show the place to prospective lenders for appraisal. Also, if the landlord has the place up for sale, it can be shown to potential buyers.

If your landlord wants to inspect the home, it is perfectly legal to do so. However, this cannot happen within the first three months that you move in. Inspections can only be performed every six months. If inspections are performed without proper notice they may violate quiet enjoyment rights.

Any time the landlord enters your home you must have 24 hours notice. You must be provided the reason and informed of the time of entry. The visit must be during reasonable hours and not on holidays. There are other reasons for entry and it is important to get legal advice before taking action. This article is provided for general information and should not be considered legal advice for quiet enjoyment issues.
